Privacy and Data Protection Policy and Notice (“Privacy Policy”)

1. YOUR CONSENT TO THE PRIVACY POLICY   

Your access and use of any, or all, of the website(s) (“Site(s)”) and Services of Skilled Volunteers for Israel (including, but not limited to “SVFI” “we,” “our,” “us,” “www.SkilledVolunteerIsrael.org”) and its entities  (including, but not limited to, English B’Yachad, “EBY,” “ENGLISH B’YACHAD,” “www.ebyachad.com,” “www.ebyachad.org,” “English B’Yachad Tutor Hub,” “Tutor Hub,” and “Tutor Connections”) are subject to this Privacy Policy. 

 

This Privacy Policy applies to all Services and Sites of Skilled Volunteers for Israel and its afore-mentioned entities known collectively and individually, as Skilled Volunteers for Israel, (SVFI). As stated in this Privacy Policy, you agree to SVFI’s practices for collecting, using, maintaining, processing, and disclosure of your Personal Information (“Personal Data,” “Data,” “Sensitive Information,” “Personal Sensitive Information”).

Your access of any of our Sites and/or Services signifies your acceptance of these policies. If you do not agree to the collection, use, maintenance, processing, and disclosure of your Personal Information as described in this Privacy Policy, please do not access or use our Website(s) and/or use our Services. 

Our Services include but are not limited to:

  • Activities related to volunteering include but are not limited to interviews, screening, matching, orientation, training, follow-up, volunteer positions, and roles

  • Utilizing Information platforms aligned with volunteer activities including but not limited to websites, social media, blogs

2. ABOUT THE SVFI PRIVACY POLICY

SVFI respects the privacy of its constituents, donors, customers, partners, staff, volunteers, vendors, web visitors, students, and others with whom we engage (hereinafter referred to as “Constituents”). To learn more about what type of information is collected from you when you visit our Sites and how that information may be used, please read this Privacy Policy.  

 

Constituents who wish to engage with us or to use our Services may be asked to provide SVFI with Personal Information. Individuals may provide Personal Data when: using our Services; as a student; volunteering; visiting our websites and portals; at any of our physical sites: applying for staff positions; donating to us; completing a form/s; working for us; consulting; partnering; participating on our board of directors; visiting our Web Site/s; or otherwise engaging with us.  

 

Please read the following carefully to understand our practices regarding your personal data and how we will treat it.

 

3. WHAT IS THE PURPOSE OF PERSONAL DATA WE COLLECT?

The data we collect is essential for the purpose of conducting the business of SVFI and English B’Yachad, as well as to enhance our Constituents’ overall experience. We aim to process only adequate, accurate, and relevant data limited to the needs and purposes for which it is gathered and only process data in accordance with this Privacy Policy. We aim to store data for the time period necessary to fulfill the purpose for which the data is gathered. We use Personal Data to provide and improve the Services and meet our contractual, ethical and legal obligations. Examples include: 

  • Carrying out our obligations arising from any contracts, agreements or services entered into between you and SVFI and English B’Yachad; and/or any contracts entered into between a Constituent and us; or between Constituents.

  • Providing you with information and Services that you request from us. 

  • Administering your file with us.

  • Verifying and carrying out financial transactions in relation to payments you make in connection with Services.

  • Notifying you about changes to Services.

  • Replying to your queries. 

  • Troubleshooting problems. 

  • Detecting and protecting against error, fraud or other criminal activity.

  • Contacting you to give you information. 

  • Contacting you to provide technical assistance and other related information about Services.

  • Inviting you to take part in other programs offered by us.

  • Contacting you to inform you of additional services which may be of interest to you.

  • Marketing and promotional purposes. 

  • Compliance and audit purposes, such as meeting our reporting obligations in our various jurisdictions and for crime prevention and prosecution insofar as it relates to our staff, members, facilities, and other Constituents. 

  • For security purposes and to identify and authenticate your access to the Services.

  • Other as may arise.

4. WHAT INFORMATION DO WE COLLECT? 

We collect and process non-identifiable and anonymous information prior to, and from, your use of the Services and Sites. We also collect several categories of Personal Data, including Sensitive Personal Data, through your use of our Sites and Services. This may include the first and last name(s) of you, your spouse/significant other, and dependents, as well as nickname(s); birthdate(s); gender(s); nationality(ies); job title(s); phone number(s); address(es); city(ies); county(ies); country(ies); postal code(s); email(s); other contact details; family status; bank account(s), credit card(s) and other such payment and billing details; employment history(ies); background checks; vocational and academic skills; qualifications; interests; preferences; and other information, including information you may choose to share with us.

SVFI may collect other Sensitive Personal Data about an individual’s racial or ethnic origin, political opinions, religious or similar beliefs, trade union membership or non-membership, physical or mental health or condition, criminal offenses or related proceedings; or any other data considered as sensitive under applicable law (“Sensitive Personal Data“). 

SVFI also collects the email addresses of people who communicate with us via email; through messenger services; or contact us through any other social/social media platforms or other platforms currently in existence or created after the date of this Privacy Policy; or by creating accounts and login credentials.

There is no legal obligation to provide any information to us.

You do not have any legal obligation to provide any information to us. However, we require certain information to provide some of our Services. If you choose not to provide us with certain information, we may not be able to provide you with the Services. 

5. HOW DO WE COLLECT PERSONAL DATA?

There are two main methods we use to collect personal data:

We collect Personal Data through your use of any or all of our Web Sites (including but not limited to www.SkillVolunteerIsrael.org, www.EnglishBYachad.com, and/ or EnglishBYachad.org. In other words, when you use our Sites or applications, we are aware of it and may gather, collect and record the information relating to such usage, either independently or through the help of third-party services as detailed below. This may include technical and behavioral information such as the User’s Internet Protocol (IP) address used to connect your computer to the Internet; uniform resource locators (URL); operating system; browser type; browser plug-in types and versions; screen resolution; Flash version; time-zone setting; the User’s click-stream’ on the website; period of time the User visited the website; methods used to browse away from a page; and any phone number used to call us or our related entities. Likewise, we may place cookies on your browsing devices. 

We also collect data by corresponding with you, through oral, digital and written means of correspondence, and when we work with you to fulfill volunteer-student pairs with-for our partners. In any combination of Constituent relationships, such data may be gathered.  

Any Personal Data that you provide us may be combined with personal data which may be provided by other sources such as those described below, all of which may be used for the purposes set forth in this document.


 

6. HOW DO WE SHARE THE INFORMATION WE COLLECT?

There is no Sharing or Selling of Personal Data to other third parties.

We will NEVER sell or share any of your Personal Data or Sensitive Personal Data to third parties except as needed to conduct business with our partners and trusted third-party services we use such as Google, Salesforce, Facebook, Zoom, Mailchimp, Survey Monkey and Wufoo and others to facilitate our Sites and Services. 

Opt-in Policy for Constituent Images

We have an opt-in policy for the use of personal Images (which includes pictures and photographs of you, including any of the various formats and derivatives that exist now or in the future).  When you participate in our programs or events of any kind, we may take, or be provided with, photos and/or images of you.  However, before we use them, we require that you provide explicit permission IN WRITING before we can publish them for any or all of our needs. 

These needs include, but are not limited to, marketing, advertising, promotions, digital use, resource mobilization; and other materials. Materials include, but are not limited to printed and online deliverables; websites; social media; presentations; press releases; donation requests; partner marketing; meeting and teaching/tutoring/mentoring materials; and more. We determine these needs based on our legitimate interests in promoting the programs and events held by SVFI and the services we provide. 

 

We use Constituent testimonials on our sites and other media (as listed in the preceding paragraph), which may contain Personal Information, only with the express written permission of the author. Before doing so, we obtain each customer's specific consent, via email or at the time of collection in writing on an SVFI-approved form. With this permission, YOU ARE GIVING US PERMISSION TO EDIT AND USE YOUR SUBMISSION FOR CLARITY AND SUCCINTNESS without changing the intent or meaning.

 

Transfer of Personal Data

We may transfer your personal data for purposes including to:

  • Store or backup the information;

  • Enable us to provide you with the Services and fulfill our contract with you;

  • Fulfill any legal, audit or compliance obligations which require us to make that transfer;

  • Facilitate the operation of our organization, where it is in our legitimate interests and we have concluded these are not overridden by your rights;

  • To offer our Services across multiple jurisdictions; and

  • To operate our organization, subsidiaries and affiliates in an efficient and optimal manner.

We may transfer Personal Data to:

  1. Related organizations, subsidiaries and affiliates. This includes any member of our group, which means our subsidiaries, whether wholly or partially owned by us, in Israel, in the US and elsewhere, as well as our joint-venture partners who support our processing of Personal Data under this Privacy Policy. It includes constituents, affiliates and other partners for which we provide our Services, as well as our volunteer tutors, students and partners.

  2. Third Parties. We transfer personal data to third parties in a variety of circumstances. We strive to ensure that third parties use your data only to the extent necessary to perform their functions. These third parties may include business partners, suppliers, affiliates, agents, and-or sub-contractors for the performance of any contract or implied contract, we enter into with you. They may assist us in providing the Services we offer; processing transactions; fulfilling requests for information; receiving and sending communications; analyzing data; providing IT and other support services; or other tasks. These third parties may also include analytics and search engine providers that assist us in the improvement and optimization of our website and our marketing.   

We periodically add and remove third-party providers. At the time of this document, our third-party providers (who likely or do use the Cloud, Servers, or the like, to host their services) to whom we may transfer personal data include the following:

  • Salesforce and previously used Customer Relationship Management systems

  • Google Analytics

  • Wix website platform, Wix forms, other forms, widgets and plug-ins

  • Email Marketing software such as Mailchimp and Wix

  • Zoom 

  • WhatsApp, Facebook and other social media

  • Visitors Registration system

  • Project Management system

  • YouTube

  • Recruiting and applicant management software

  • Accounting management services

  • Survey companies

  • Wufoo (forms and surveys)

  • Survey Monkey

  • Other

We strive to collaborate with companies that uphold strong privacy policies consistent with industry standards, akin to our own. However, our vendors operate under their independent privacy policies. Despite our efforts to engage only with vendors renowned for their robust security measures, we do not oversee, nor dictate, their data management and security practices and SVFI cannot be held liable under any circumstance for any of their lapses thereof.

Transfer of Information to Third Parties Upon a Sale or Change of Control. 

We retain the right to transfer or assign all Personal Information and other data and information pursuant to a merger, purchase or other transaction relating to SVFI or our affiliates or our assets if the assignee or purchaser agrees to abide by the terms of this Privacy Policy.

Duty to disclose data under certain conditions

In addition, we may disclose your personal data to third parties if we are under a duty to disclose or share your personal data in order to comply with any legal or audit or compliance obligation, in the course of any legal or regulatory proceeding or investigation, or to enforce or apply the terms of a contract we have with you or for you; or to protect the rights, property, or safety of SVFI, our staff and Constituents, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction and to prevent cybercrime.

For avoidance of doubt, SVFI may transfer and disclose non-personal data to third parties at its own discretion.

Limitations of SVFI's Responsibility for Privacy and Security in Relation to Third-Party Vendors, Related Organizations, Subsidiaries, Affiliates and Volunteers. SVFI is not responsible, and cannot be held responsible, for ensuring the privacy and security measures implemented by such entities. While we engage with these parties to provide various services or products, the safeguarding of privacy and security aspects within those interactions falls under the purview of the parties themselves. SVFI does not directly oversee or control the security practices employed by these external partners/vendors. It is essential for Constituents to be aware that when dealing with third-party vendors, they should independently assess the vendor's privacy and security policies to ensure that their personal and sensitive information is adequately protected.

7. WHERE DO WE STORE YOUR DATA?  

SVFI stores data from its various locations as follows:

  1. SVFI, for its English B’Yachad program, uses data gathered on various websites to match volunteer tutors with students requesting our services in Israel. For matching purposes, data gathered in Israel and elsewhere, and data gathered from volunteers are stored together on our customer relations management platform.  Data is also stored on our third-party websites, and on our Volunteers’ computers.  Once we share information with volunteers, students and third parties, we lose control since we do not, and can not, oversee the security of their devices.

Security of your Personal Information
We use a variety of security technologies and procedures to help protect your Personal Information from unauthorized access, use or disclosure. However, it is not possible to guarantee absolute security of electronic information, and by providing your information and using the Site, you acknowledge the risk of storing and transmitting electronic information over the Internet.

Please note that Personal Data may be either deleted or retained in an aggregated manner without being linked to any identifiers or Personal Data, depending on technical commercial capability. 


 

8. HANDLING PERSONAL DATA ON NON-ORGANIZATIONAL DEVICES AND ITS IMPLICATIONS FOR PRIVACY AND SECURITY 

In addition to our data management practices within the organization, it is important to acknowledge that personal data for our business purposes will be accessed and utilized on the personal and office computers of our staff, volunteers, students, and partners. 

The security measures on personal devices can vary significantly from one individual to another. SVFI is not in any way responsible, and cannot be held responsible, for ensuring the privacy and security measures implemented on the personal and office computers of our staff, volunteers, students, partners, and others.

While we maintain a foundation of trust in our interactions with these stakeholders, it's crucial to recognize that once the data is transferred to a personal computer, we are no longer able to guarantee the same level of privacy or security control that our organizational systems provide. Please also note that we have no control or responsibility for Personal Information provided to or stored by organizations with which our volunteers may be placed. 

9. WEBSITE DATA COLLECTION, COOKIES, AND OTHER CURRENT, SIMILAR AND FUTURE DIGITAL TECHNOLOGIES

We collect Personal Data required to provide Services when you register with us. In addition, we collect your Personal Data when you provide information when filling out forms or by otherwise engaging with us. We collect other data, including but not limited to, the following:


Social Media Features and Widgets

Our websites include Social Media Features such as, but not exclusively, the Facebook Like button, social icons, widgets such as the Share-Share This button, and interactive mini programs that run on our Sites). These features may collect your IP address and the pages you visit on our Site, and may also set cookies to enable the feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. 

This Privacy Policy does not apply to these features.  Your interactions with these features are governed by the privacy policy and other policies of the companies providing them.

Cookies

When you access or use our Services, we may use industry-standard technologies such as “Cookies”, pixels and similar-future technologies, which store certain information on your computer or browsing device; these allow us to identify the computer or device with the user; enable the automatic activation of certain features; and make the Service experience more convenient and effortless. 

We use different types of Cookies. Some cookies are strictly necessary; they are required for the operation of our Site and under our terms with you. This includes, for example, cookies that enable you to log into any current or future secure areas of our Service. 

We also use analytical and performance monitoring cookies, which allow us to recognize and count the number of visitors and to see how visitors move around our website when they are using it, as well as other analytics. We also use functionality cookies which are used to recognize you when you return to our Site. This enables us, subject to your input, to personalize content to your preferences, such as your selected language or region.

Different cookies are kept for different periods. Session cookies are used to keep track of your activities online in a given browsing session; these cookies generally expire when the browser is closed but may be retained for a period on your device. Permanent cookies remain in operation even when you have closed the browser; they are used to remember your login details and password. 

We use Cookies and other technologies on the basis that they are necessary for the performance of a contract with you, or because using them is in our legitimate interests and these are not overridden by your rights.

You are not required to accept our cookies when you visit our Sites.

Allowing or disabling cookies is your choice and in your control. Most browsers will allow you to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. You may delete our cookies as soon as you leave this site. To disable cookies on our website, change your browser settings to reject cookies. The process for accomplishing this will vary based on the specific browser you are using. Consult with an Information Technology (IT) specialist or other individual who can help you accomplish this. We cannot, and do not, provide advice on the operation of your computer. While we may assist you in using Zoom to work with any of our Constituents, we cannot be held responsible for any computer issues you may encounter before, during and after the process.

Be aware that if you set your browser to reject cookies, you will not be able to use all the features and functionality of the Site. Your online experience on our website will be limited.

Third-Party Cookies

Third-party cookies are installed by third parties with the aim of collecting certain information to research behavior and demographics. Third-party cookies on our site include, for example, Google Analytics. Likewise, pixels from Meta, Facebook and others enable integration of third-party service providers (e.g. Facebook, X (formerly Twitter) on our site. Third-party cookies will be retained according to the terms of those third parties; you can control those cookies in your browser settings.

Google Analytics Notice 

We use Google Analytics, which uses cookies to analyze website traffic. For instance, Google Analytics tells us how many people have visited our website, what pages they visit, and how long they visit each page.  You can visit  https://policies.google.com/technologies/partner-sites to learn more about how Google uses the information collected.  

Re-marketing
Our Sites may also use third-party vendor re-marketing tracking cookies, including Google Ads tracking cookies. This means we will continue to show ads to you across the internet, specifically on the Google Content Network (GCN) or Social Media Sites. In this instance, we are not collecting any identifiable information using Google’s or any other 3rd party remarketing system. The third-party vendors, including Google, whose services we use, will place cookies on web browsers to serve ads based on past visits to the Site. This allows us to make special offers and continue to market our services to those who have shown interest in our service.

Do Not Track Information
Many internet browsers have "Do Not Track" features which, when turned on, send a signal (the "DNT signal") to the websites a user visits that indicates the use does not want to be tracked.  Because there is not yet a common understanding of how to interpret DNT signals, and there is no common definition of "tracking", we do not currently respond to DNT signals on the Site.  We do not engage in targeted behavioral advertising.

 

Cross-Border Transfer

The Sites are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country, or territory other than that of the United States. Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and, by using the Sites, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than those of your country.

Web Beacons 
In addition to cookies, we may also use “Web beacons” or similar Web technologies to collect information about our visitors and the ways they use the Site. For example, if we send an e-mail to you, the e-mail may contain a Web beacon. The Web beacon sends a signal back to us when you open the e-mail so that we can track the effectiveness of our e-mail campaigns. The information we collect using these technologies does not identify you personally; however, we may link this information to information that identifies you personally, such as your e-mail address. 
 

Click-Through Agreements
Before using certain areas of the Site, for example, participating in our Member-Tutor Community or other activity, you may be asked to indicate your acceptance of certain special terms and conditions by clicking on a button marked “O.K.” or “I agree.” Any special terms and conditions that you agree to will supplement and amend this Privacy Policy, but only with respect to your use of those areas of the Site.

Use of Navigational Information
Navigational information tells us how users move through the Site. Information about how users move through the Site helps us better organize the information, improve the Site experience, and personalize the content offered to Site visitors. We may also use navigational Information alone or in combination with Personal Information to provide you with personalized content about our products and services.

Privacy Policy as it Related to Personal Information on Third-Party Sites

This Privacy Policy does not apply to Personal Information collected on any third-party website. In most cases, third-party websites and externally linked sites have their own policies regarding privacy. We recommend you review the Privacy Policy posted on any site you visit before using the site or providing any Personal Information about yourself. SVFI is neither responsible nor liable for the content, operation, security or privacy policies of any such third-party or linked sites. 

Privacy Policy as it Relates to Links to External Sites

Our websites contain links to external sites.  These are sites that are owned and operated by third parties. SVFI is neither responsible nor liable for the content, operation, security or privacy policies of any such third-party or linked sites. 

Postings and links on our website, including on the Israel Volunteer Directory (IVD), to any and all third-party sites does not, and is not intended to, constitute an endorsement of any individual, organization or entity.  Instead, all information, content, and description available on such sites are for general informational purposes only.  Information in the IVD and other sites, may not constitute the most up-to-date opportunities or other information; Skilled Volunteers for Israel and its constituents are not responsible for any content or representations made. Note that the Israel Volunteer Directory, and other sites, contains links to other third-party websites.  Such links are only for the convenience of the reader, user or browser.  Skilled Volunteers for Israel and its constituents neither recommend nor endorse the contents of these postings nor any third-party sites and links.

 

10. DATA RETENTION, INFORMATION STORAGE AND SECURITY

Data Retention

SVFI will retain the data it processes only for as long as required to provide the Services and as necessary to comply with its legal obligations, resolve disputes, and enforce its agreements. Such information may continue to be used by SVFI for the purpose of operating the Services and for statistical analysis. Data will be kept in accordance with applicable best business practices and legal obligations.

Please note that some data will not be deleted and shall be kept in an anonymized manner. 

Some metadata and statistical information concerning the use of the Services are not subject to the deletion procedures in this policy and may be retained by SVFI. However, we may not be able to identify you from this data. 

Some data may also be retained on our third-party service providers’ servers until deleted in accordance with their Privacy Policy and their retention policy.  


We do not store any credit card information on our systems. 

If you provide credit card information, we use it solely to collect payment from you and use a third-party service provider to manage credit card processing. This service provider is also not permitted to store, retain, or use information you provide except for the sole purpose of credit card processing on our behalf.

Access to Personal Data

Within SVFI, we endeavor to limit access to Personal Data to those of our personnel who: (a) require access in order for SVFI to fulfill its obligations under this Privacy Policy and its agreements; (b) have been appropriately and periodically trained on the requirements applicable to the processing, care and handling of the Personal Data; and (c) are under confidentiality obligations as required under applicable law. We take steps to ensure that its staff who have access to Personal Data are honest, reliable, competent and trained.

We take care in implementing, enforcing and maintaining the security of the personal data we process. SVFI endeavors to implement, enforce and maintain security measures, technologies and policies to prevent the unauthorized or accidental access to, or destruction, loss, modification, use and/or disclosure of Personal Data. Where we deem it necessary in light of the nature of the data in question and the risks to data subjects, we may encrypt data. Likewise, we take industry-standard steps to ensure our website is safe.

Note however, that no data security measures are perfect or impenetrable, and we cannot guarantee that unauthorized access, leaks, viruses and/or other data security breaches will never occur.  

 

Notification of Data Breach

SVFI shall act in accordance with the law to notify the relevant authorities and data subjects in the event that any Personal Data processed by SVFI is lost, stolen, or where there has been any unauthorized access to it, all in accordance with applicable law and on the instructions of qualified authority. We shall promptly take reasonable remedial measures.

11. DATA SUBJECT RIGHTS – MODIFICATION OR DELETION OF PERSONAL DATA

Constituents may have a legal right under certain applicable laws to receive, rectify, erase, and restrict Personal Data, including Sensitive Personal Data, about them that is held by us, to object to processing and, if processing occurs based on consent, to withdraw their consent.

 

If, for any reason, a Constituent wishes to modify, delete or retrieve their Personal Data, they may do so in writing by contacting SVFI. SVFI shall perform the necessary process to identify the Constituent as a Constituent who has the right to retrieve the specific information and then furnish the data required to be amended, deleted or retrieved together with a specific identification of the Customer and data. 

Constituents should be aware that information shared on external platforms, like social media (e.g. Facebook, YouTube), that is later taken down, doesn't necessarily hinder its potential spread in the future. 

Data subjects have rights under General Data Protection Regulation (GDPR)( a  European Union law on data protection and privacy) and local laws, including, in different circumstances, rights to access data, rectify data, object to processing, and erase data. It is clarified for the removal of doubt, that data subject rights cannot be exercised in a manner inconsistent with the rights of SVFI’s employees, with our proprietary rights, and third-party rights. As such, job references, reviews, internal notes and assessments, documents and notes including proprietary information or forms of intellectual property, cannot be accessed, erased or rectified. In addition, these rights may not be exercisable where they relate to data that is not in a structured form (for example, emails), or where other exemptions apply. If processing occurs based on consent, data subjects may have a right to withdraw their consent.

If, for any reason, a data subject wishes to exercise these rights and modify, delete or retrieve their Personal Data, they may be able to do so by contacting SVFI. Note that SVFI may have to undertake a process to identify a data subject exercising their rights. SVFI may keep details of such rights exercised for its own compliance and audit requirements. Please note that Personal Data may be either deleted or retained in an aggregated manner without being linked to any identifiers or Personal Data, depending on technical commercial capability. Such information may continue to be used by SVFI.

Minors

With regard to Personal Data about a minor under 16 years old, SVFI will endeavor to process personal data only with the consent of the holder of parental responsibility over the minor. SVFI will make reasonable efforts to verify that consent is given or authorized by the holder of parental responsibility of the child but cannot take responsibility for misrepresentation by persons as to their age.

 

12. CHANGES TO THIS PRIVACY POLICY
